Privacy Policy

1. Introduction

Justin James Sutcliffe trading as Sharply (ABN 67 456 073 358) ("Sharply", "we", "us", "our") is committed to protecting your privacy and handling your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Privacy Policy explains what personal information we collect, how we use and disclose it, how we store it, and your rights in relation to it. By using our Service, you acknowledge that you have read and understood this policy.

2. Information We Collect

2.1 Subscriber Information

When you sign up for Sharply, complete the Assessment, or interact with us, we may collect your name, email address, phone number, business name, job title, industry, company size, LinkedIn profile URL, and payment details (processed and stored securely by Stripe — we do not store your full card number).

2.2 Prospect Information (Third-Party Data)

As part of delivering the Service, Sharply collects and processes publicly available information about business professionals who may be relevant sales prospects for our subscribers. This information is sourced from public databases, company websites, professional networking platforms (such as LinkedIn), news publications, and third-party data providers (including Apollo.io). It may include names, job titles, company names, business email addresses, phone numbers, and publicly reported business activities.

2.3 Usage Data

We collect information about how you interact with the Service, including login times, dashboard activity, dossier views, and feature usage. This helps us improve the Service and tailor delivery to your needs.

2.4 Communications

If you contact us via email or other channels, we retain the content of those communications for the purpose of responding to you and improving the Service.

3. How We Use Your Information

We use the information we collect for the following purposes:

(a) to provide, operate, and maintain the Service, including delivering Dossiers and deal coaching insights;

(b) to conduct your Assessment and calibrate the Service to your business needs;

(c) to process payments and manage your subscription;

(d) to communicate with you about your subscription, service updates, and support enquiries;

(e) to improve and develop the Service, including refining our research methodology and AI-driven analysis;

(f) to comply with our legal obligations and enforce our Terms and Conditions;

(g) to protect the rights, safety, and property of Sharply, our subscribers, and the public.

4. Third-Party Service Providers

We share information with the following categories of third-party service providers, solely to the extent necessary to operate the Service:

We require all third-party providers to handle your data in accordance with applicable privacy laws. We do not sell, rent, or trade your personal information to any third party for marketing purposes.

5. AI Processing

Sharply uses artificial intelligence (powered by Anthropic's Claude API) to research prospects, analyse trigger events, generate dossier content, and score leads. Data sent to the AI is processed via API calls and is subject to Anthropic's data handling policies. We do not use your subscriber data to train AI models. Dossier content generated by AI is reviewed for quality but may contain inaccuracies — subscribers should independently verify material facts before relying on them.

6. Data Storage & Security

Your data is stored using industry-standard cloud services (Airtable, Vercel, Stripe). While we take reasonable steps to protect your information through access controls, encryption in transit (HTTPS/TLS), and secure authentication, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.

We retain your personal information for as long as your subscription is active, and for a reasonable period afterwards to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your data at any time (see Section 9).

7. Cookies & Tracking

Our website and dashboard may use essential cookies required for authentication and session management. We do not currently use third-party analytics or advertising cookies. If this changes, we will update this policy and notify you.

8. Prospect Data & Third-Party Rights

Sharply collects publicly available business information about prospects as part of its Service. If you are an individual whose information appears in a Sharply Dossier and you wish to request access to, correction of, or deletion of your information, please contact us at hello@sharply.au. We will respond to such requests within 30 days.

We source prospect data from publicly available channels and do not knowingly collect sensitive information (as defined by the Privacy Act 1988) about any individual.

9. Your Rights

Under the Australian Privacy Principles, you have the right to:

(a) Access — request a copy of the personal information we hold about you;

(b) Correction — request that we correct inaccurate, out-of-date, or incomplete information;

(c) Deletion — request that we delete your personal information, subject to our legal obligations to retain certain records;

(d) Complaint — lodge a complaint with us if you believe we have breached the APPs. If you are unsatisfied with our response, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

10. Cross-Border Disclosure

Some of our third-party service providers (including Stripe, Airtable, Anthropic, Apollo, Resend, and Vercel) are based in or operate infrastructure in the United States. By using the Service, you consent to your information being transferred to and processed in jurisdictions outside Australia. We take reasonable steps to ensure that overseas recipients handle your information in accordance with the APPs.

11. Children's Privacy

The Service is designed for business professionals and is not directed at individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us and we will promptly delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email at least 14 days before they take effect. The "Last updated" date at the top of this page indicates when the most recent revision was made.
